ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 05.01.2017, for the offences punishable under Sections 376 and 506(i) of IPC., in Crime No.1 of 2017, on the file of the respondent police, seeks bail.

2. The learned counsel appearing for the petitioner states that the petitioner has not committed any offence, as alleged by the respondent Police and it is true that both the petitioner and the defacto complainant are love affairs, since both their family not accepted for their marriage, the petitioner married one Thilagavathi and even after that, the defacto complainant compelled the petitioner to marry her and when he refused for the same, she has lodged the present false case against him.

3. The learned Government Advocate (crl.side) appearing for the respondent states that the petitioner is the sole accused in this case. The petitioner fell in love with the victim girl, who is aged about 20 years. He would further submit that subsequently, the petitioner has married an another girl and thereafter also, he followed the victim and without her consent, he is having physical contact with the victim stating that he is preparing to divorce the first wife, but he refused to marry the victim and also made a threat against the victim not to disclose the physical contact and https://hcservices.ecourts.gov.in/hcservices/

the investigation is still pending.

4. Considering the above facts and circumstances of the case and also considering the gravity of the charge against the petitioner herein in the commission of offence and the investigation is still pending, this Court is not inclined to grant bail to the petitioner, at this stage, and hence, the Criminal Original Petition stands dismissed.
