Respondent/Respondent/ Defendant PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the learned VI Additional District Judge, Madurai (now V Additional District Court, Madurai -in-charge) to expedite the execution proceedings in E.P.No.23 of 2020 pending on its file within the time stipulated by this Court on merits and in accordance with law.

ORDER

The present civil revision petition stands disposed of at the time of admission without expressing any opinion on the merits of the case that the petitioner is aged about 82 years.

2. It appears that the petitioner has filed E.P.No.23 of 2020 before the VI Additional District Court, Madurai and that there is no presiding Officer in the VI Additional District Court, Madurai.

3. The learned counsel for the petitioner submits that the V Additional District Judge is in charge of the VI Additional District Court's cases.

4. Considering the fact that the petitioner filed E.P. in the year 2020 in respect of the preliminary decree passed on 06.01.2019 and final decree passed on 09.01.2019, there shall be a direction to the Principal District Judge, Madurai to transfer the case before the in-charge Court (V Additional District Court, Madurai), in case, vacancy caused by the transfer of VI Additional District Judge is not filled up by another 30 days.

5. The present Civil Revision Petition stands disposed of with the above observations. The Court concern shall expedite the disposal of 2/4

E.P.No.23 of 2020 preferably within a period of 12 months from the date of receipt of copy of this order. No costs.
