*********** [Order of the Court was made by C.T.SELVAM, J.] The petitioner has come up with this Writ Petition seeking a Writ of Mandamus, directing the second respondent to take action based on the communication sent by the first respondent dated 07.04.2018 in O.Mu.M.2/12478/2018 within a time stipulated by this Court.

2. The petitioner, who is stated to be a resident of Thammathukonam Village, Nagercoil, Kanyakumari District, has submitted a representation dated 20.03.2018, before the first respondent seeking to remove the encroachment made in Survey No.525, Neendakarai A East Village, Thammathukonam, Agastheeswaram Taluk, Kanyakumari District and to ensure free flow of water through the channel. The said representation, till date, remains unanswered.

3. We have heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.

4. Mr.R.Sethuraman, learned Special Government Pleader, appearing for the respondents, on instructions, informs that the representation of the petitioner dated 20.03.2018 will be considered by the second respondent on merits and in accordance with law.

5. Recording the said submission, the Writ Petition is disposed of with a direction to the second respondent to consider the representation of the petitioner dated 20.03.2018 and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order and the outcome of the representation of the petitioner shall be intimated to him. No costs.
