O R D E R

The Civil Revision Petition had been preferred against the fair and decreetal order passed in I.A.No.266 of 2013 in O.S.No.489 of 2011 dated 27.11.2013 on the file of the Principal District Munsif Court, Tirunelveli.

2. The petitioner has filed a petition under Order 23 Rule 1(3) C.P.C seeking permission to withdraw the suit and to file a fresh suit for the same cause of action and the same was dismissed by the trial court. Against which, the petitioner is before this Court.

3. When the matter is taken up for hearing, the learned counsel for the respondent submitted that the suit itself is dismissed on 12.06.2017 and therefore, nothing survives for adjudication in this civil revision petition.

4. In view of the above, the Civil Revision Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is also dismissed.
