No. 152 of 2023 on the file of the Sub Court, Sivakasi and O.S. No. 120 of 2020 on the file of the District Munsif Court at Sivakasi exists between the petitioners and respondents 3 to 5 and not to harass the petitioners under the guise of enquiry at the instance of the 2nd respondent.

ORDER

When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that on basis of the complaint given by the third respondent, enquiry was undertaken. During the course of enquiry, it was found that the issue is between the partners. Whether the complaint can be entertained for enquiry by the respondent police, on that ground an legal opinion was sought from the Legal Officer. The Legal Officer has given opinion that this is not a fit case for enquiry. On the basis of the legal advise, the further action has been dropped.

2. In view of the above submission, nothing survives for further consideration in this matter. Hence, this Criminal Original Petition is disposed of as infructuous.
