PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records relating to FIR in Crime No.823 of 2016 dated 27.11.2016 on the file of the Inspector of Police, Thoothukudi Central Police Station, Thoothukudi and quash the same as against the petitioners.

ORDER

This petition has been filed to quash the proceedings in Crime No.823 of 2016 on the file of the respondent police.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the first respondent.

3. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) would submit that the investigation in the case in Crime No.823 of 2016 has been completed and final report has also been filed before the concerned Magistrate and the same is taken on file in C.C.No.22 of 2019 on the file of the learned Judicial Magistrate, Thoothukudi.

4. Since the investigation in this case has been completed and

final report has been filed before the concerned Magistrate and the same is taken cognizance by the learned Magistrate. Apart from that no case is made out to quash the FIR, hence, the relief sought for by the petitioner cannot be granted at this stage. Accordingly, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to pursue his remedy in the manner known to law. Consequently, connected miscellaneous petition is closed.
