O R D E R

The second respondent herein was granted bail by me vide order dated 27.02.2020 in Crl.OP(MD) No.2912 of 2020. To cancel the same, this Criminal Miscellaneous Petition has been taken out by the defacto complainant.

2.Today when the matter was taken up for hearing, the learned Government Advocate submitted that the investigation is over and charge sheet is about to be filed.

3.The learned counsel for the second respondent would inform the Court that as and when the prosecution takes out an application for selling the property (House property and Jewels), the second respondent will not oppose the same. This undertaking given by the second respondent through her counsel is placed on record.

Crl.M.P(MD) No.3103 of 2020 4.The prosecution is directed to file Final Report at the earliest and after that the prosecution shall take action for selling the property. The learned Magistrate will ensure that the properties fetch the martket value. Thereafter, the amount shall also to be distributed among the depositors on pro-rata basis and in view of the above, I am not inclined to cancel the bail granted to the second respondent.

5.With the aforesaid directions, this Criminal Miscellaneous Petition is disposed of.
