To prefer this Memorandum of Grounds of Writ Appeal against the order dated 31.08.2016 made in W.P.(MD)No.11163 of 2016 by this Court.

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 4th respondent to deliver the original registered document no. 1709 of 2016 dated 10.06.2016 to the petitioner without insisting upon payment of additional stamp duty. For petitioners : Mr.V.R.Shanmuganathan, Special Government Pleader For respondents : No appearance

ORDER

[Order of the Court was made by M.SATHYANARAYANAN, J.] Mr.V.R.Shanmuganathan, learned Special Government Pleader appearing for the review applicants would submit that in the light of the fact that the document in question has been released to the first respondent, nothing survives for further adjudication in this matter and would further add that in compliance of the judgment reported in 2017 (5) L.W. 212 (The Special Deputy Collector (Stamps), Palayamkottai, Tirunelveli District and another Vs. M.Alfred and others), the Commercial Taxes and Registration Department has also issued G.O.Ms.No.174, dated 28.11.2017, by amending the rule and prescribing time limit for making a reference under Section 47-A of the Indian Stamp Act.

2. In the light of the said development, nothing survives for further adjudication in this review application and hence, it is closed. No costs. Consequently, connected miscellaneous petition is also closed.
