PRAYER:- FOR BAIL IN CRIME NO.577/2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 27.12.2023 for the alleged offence punishable under Sections 392, 397 IPC r/w Section 27(1) of the Arms Act in Crime No.577 of 2023, seeks bail. 1/3

2. The case of the prosecution is that the petitioner along with other accused persons took a sum of Rs.1,500/- from the defacto complainant and threatened him by showing knife. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution. Further, an earlier bail application filed by the petitioner was dismissed by this Court on 19.02.2024 and the petitioner is in judicial custody more than 50 days. Hence, he prays for bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that five previous cases are pending against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the fact that five previous cases are pending against the petitioner and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
