ORDER
Seeking to quash the impugned proceedings of the charge sheet in S.T.C.No.630 of 2025 on the file of the learned Judicial Magistrate Court, Thiruvadanai, this criminal original petition is filed. 2.Since no adverse order is likely to be passed against the second respondent, notice to him is dispensed with.
3.The learned counsel for the petitioners submitted that the petitioners herein are Accused Nos.1 to 6 in the pending S.T.C.No.630 of 2025 on the file of the learned Judicial Magistrate Court, Thiruvadanai, in connection with Crime No.229 of 2019 which was registered on 27.12.2019 by the first respondent for the offences under Sections 147, 294(b), 353 and 506 (1) of IPC and Section 66(1)(b) of Tamil Nadu Panchayats Act, 1994. However, only after a lapse of 6 years, final report was laid before the learned trial Court 26.09.2025. Since none of the offences alleged against the petitioners is punishable 2/5
with imprisonment exceeding three years, the filing of the final report after a delay of three years is barred by limitation under Section 468(2) Cr.P.C., and hence, he sought for the indulgence of this Court by quashing the impugned charge sheet.
4.The learned Government Advocate(Crl.side) fairly conceded that necessary permission under Section 473 of Cr.P.C., was not obtained from the learned trial Court before filing a final report. 5.Regarding the same, the impugned charge sheet in S.T.C.No. 630 of 2025 on the file of the learned Judicial Magistrate, Thiruvadanai, is quashed on the ground that the same is hit by Section 468(2) of Cr.P.C. Accordingly, this Criminal Original Petition is allowed. Consequently, connected Miscellaneous Petitions are closed. 26.02.2026 NCC : Yes/No Index : Yes / No Rmk 3/5
