PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioner's representation dated 06.07.2023 seeking to cancel the patta in favour of the respondents 5 to 9 and consequently, to resume back the land in Survey No.682/1 situated in Lakshmananpatti Revenue Village, Kulathur Taluk, Pudukkottai District as Government Porambokku within the time frame that may be stipulated by this Court.

ORDER

[Order of the Court was made by J.NISHA BANU, J.] By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

2.According to the petitioner, the land in Survey No.682/1 situated at Lakshmananpatti Revenue Village, Kulathur Taluk, Pudukkottai District is classified as Government Porambokku. However, the respondents 5 to 9, who belongs to same family, fraudulently obtained patta in their favour. Therefore, the petitioner made a representation dated 06.07.2023 to the respondents 1 to 4,

seeking cancellation of the patta. Since the same has not been considered so far, the petitioner has filed this Writ Petition with the aforesaid prayer. 3.Mr.P.Thilak Kumar, learned Government Pleader, who takes notice for the respondents 1 to 4, submits that the patta has been granted in favour of the respondents 5 to 9 only after conducting enquiry. 4.Recording the submission made by the learned Government Pleader for the respondents 1 to 4, this Writ Petition is dismissed. If the petitioner is an aggrieved person, he can either file an appeal before the authority concerned or file a civil suit before the competent civil forum to redress his grievance. No costs.
