Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to register the date of birth of the petitioner as 09.08.1948 in the Corporation records and to issue a Birth Certificate to the petitioner based on the application dated 14.12.2017 followed by the representation dated 20.02.2019 within a stipulated period of time.

Heard the learned counsel on either side.

2. The Writ petitioner seeks registration of her date of birth as 09.08.1948 in the Corporation records and for issuance of Birth Certificate. She had given an application dated 14.12.2017 to the authority followed by a reminder dated 20.02.2019.

3. When the matter was taken up for hearing, the learned Standing counsel appearing for Madurai Corporation pointed out that as per Rule 9(3) of the Tamil Nadu Registration of Births and Deaths Rules 2000, if the birth has not been registered within one year of the occurrence, it shall be registered by the Revenue Divisional Officer. Therefore, the petitioner will have to move the Revenue Divisional Officer and thereafter move the respondent. Officer as per the amended rules, the Writ petition stands disposed of. No costs.
