For Respondent : Mr.R.Anandharaj, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.4 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- This petition is filed seeking for anticipatory bail. 2.This Court has already granted anticipatory bail to these petitioners vide order dated 27.02.2020 with certain conditions. 3.The learned counsel appearing for the petitioners submitted that due to personal difficulties, the petitioners were not able to comply with the condition within a time prescribed in the earlier order. Since in the earlier order, it was specifically stated that if the conditions are not complied with, the petition for anticipatory bail shall stand dismissed, the petitioners have taken out new application.

CRL OP(MD). No.5231 of 2020 4.This Court is unable to entertain such submission. Once anticipatory bail is granted on condition, the petitioners are supposed to comply with the condition or to file an application seeking for modification or extension of time as the case may be. But, filing a fresh anticipatory bail will amount to reviving the earlier order, which is against the provisions of Criminal Procedure Code.
