ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 24.01.2017, for the offences punishable under Section 397 of IPC., in Crime No.40 of 2017, on the file of the respondent police, seeks bail.

2. The learned counsel appearing for the petitioners states that the petitioners are innocent and they are nothing todo with the alleged offence and they are in custody from 24.01.2017 onwards.

3. The learned Government Advocate (crl.side) appearing for the respondent states that the earlier bail application moved on behalf of these petitioners in Crl.O.P(MD)No.1632 of 2017 was dismissed by this Court, as per the order dated 14.02.2017 and there is no change in circumstances in this case, after dismissal of the earlier bail application. He would further submit that A1 is still absconding and the investigation is still pending.

4. Considering the above facts and circumstances of the case

and also considering the fact that there is no change in circumstances, after dismissal of the earlier bail application and A1 is still absconding and the investigation is not completed in this case, this Court is not inclined to grant bail to the petitioners, at this stage, and hence, the Criminal Original Petition stands dismissed.
