O R D E R
This Civil Revision Petition is filed by the revision petitioner/1st defendant for a direction seeking early disposal of I.A.No.97 of 2014 in O.S.No.101 of 2014 on the file of the learned I Additional Sub-ordinate Judge, Trichirappalli.
2. Heard the learned Counsel appearing for the petitioner. 3.No notice is necessary to the respondent as this Court intend to direct the trial Court to dispose of the interlocutory application at the earliest and it would not cause any prejudice to the respondent. 4.The petitioner submits that the plaintiff filed O.S.No.101 of 2014 against the defendants along with I.A.No.97 of 2014 under Order 39 Rule 1 & 2 of C.P.C, seeking injunction restraining the petitioner from alienating the suit property. An order of status-quo was granted by the trial Court and the same was adjourned time to time and the written https://hcservices.ecourts.gov.in/hcservices/ statement has also been filed and the suit is posted for framing of
issues, but without disposing the interlocutory application for injunction. The first defendant, who is the petitioner herein submits that he is aged 75 years and he is hospitalised for certain ailments. In view of the order of status-quo granted by the trial Court, he is unable to mobilise funds either by alienating or encumbering the property. Therefore, the petitioner prays for speedy disposal of I.A.No.97 of 2014.
5.Considering the limited prayer asked by the revision petitioner only for the early disposal of the interlocutory application, this Court directs the learned I Additional Sub-ordinate Judge, Trichirappalli to dispose of I.A.No.97 of 2014 in O.S.No.101 of 2014 on or before 30 April, 2015.
With the above direction, the civil revision petition is disposed of. No costs.
