ORDER
The petitioner/A-1, who was arrested and remanded to judicial custody on 07.02.2026 for the offences punishable under Sections 316(2), 318(2), 318(4) of BNS Act, in Crime No. 04/2026, on the file of the respondent police, seeks bail.

The case of the prosecution is that the mobile phone of the defacto complainant was hacked, and the accused persons assured the defacto complainant that they would resolve the issue by paying money to the police officials. Thereby, the accused persons received a sum of Rs. 80,00,000/- from the defacto complainant in cash and 31⁄2 sovereigns of jewels. However, the accused persons cheated the defacto complainant of the said money and jewels. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the has been in judicial custody from 07.02.2026. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, bail is sought for the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent police submitted that there is no previous case pending against the petitioner.
5. Considering the fact that there is no previous case pending against the petitioner and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner, subject to the following conditions: 2/4

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate Court-II, Pudukkottai, and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.
(b) the petitioner is directed to deposit a sum of Rs.2 lakhs to the credit of crime number at the time of producing surety and thereafter the same shall be deposited in anyone of the nationalised bank in interest accruing deposit. [c] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter as and when required for interrogation and the petitioner shall not tamper with evidence or witness and the petitioner shall not abscond either during investigation or trial. [d] the petitioner shall not tamper with evidence or witness either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action 3/4
against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
