Respondent P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertains to the impugned order passed by the respondent in Koppu No. 2024/0105/34/297645 dated 21.07.2024 and quash the same as illegal and arbitrary, consequently direct the respondent to subdivide the land in S.No.304/1A2, admeasuring 72 cents situated in Kulasekarapatti, Tenkasi Taluk, Tenkasi District and issue a separate patta for the same exclusively in the name of petitioner with reference to the petitioner's Patta Transfer Application No.2024/0105/34/297645 dated 13.06.2024 within a time frame fixed by this Court.

ORDER

The petitioner challenges the impugned order of the Tahsildar, the respondent in the writ petition.

2. Considering the non Speaking order that has been passed by the respondent, with the consent of the counsel on either side, the writ petition is taken up for final disposal.

3. The petitioner's application for separate patta has been rejected, summarily, without giving an opportunity to the petitioner to present his case along with supporting documents.

4. For the above limited reasons, the impugned order is set aside and the matter is remitted to the respondent to consider the petitioner's application afresh, after giving an opportunity by way of personal hearing to the petitioner and pass final orders, on merits and in 2/4

accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No NCC : Yes / No 07.03.2025 am To The Tahsildar, Tenkasi Taluk, Tenkasi District.
