ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) With reference to the allegations set out in the writ petition that the Free House Site patta has been granted to the ineligible beneficiaries in respect of house sites in survey No.211/1 & 211/2 in Paiyur Pillaivayal Village, Sivagangai Taluk and District, the District Adi Dravidar & Tribal Welfare Officer, Sivagangai 2/6
filed a status report, which would reveal that the patta granted in favour of the ineligible persons were cancelled and eligible persons were identified and Patta has been granted. The said fact has been stated in para 6 of the status report, which reads as under:- "6. It is respectfully submitted that when malpractice issue was raised in the allocation of free house site patta and violation of assignment conditions were raised, department have took necessary action against the beneficiaries who got free house site patta without eligibility and beneficiaries who did not fulfil the assignment norms and conditions imposed thereon and after elaborate enquiry except 65 beneficiaries all other free house site allocations were cancelled on various reasons vide G.O.Ms.No. 34, Revenue Disaster Management Department, dated 13.01.2021.
Even before filing above writ petition, department have taken necessary action against the ineligible beneficiaries and have cancelled their allotments. It is respectfully submitted that on enquiry conducted by the department the present 65 beneficiaries are sanitary workers of Sivagangai Municipality and they are eligible and the remaining ineligible persons allocation of free house site pattas were cancelled by following due procedure.
survives in the present writ petition for adjudication. This respondent reserves his right to file additional status report if any when necessary.
