ORDER
The prayer in this writ petition is for a Writ of Mandamus, directing the Respondent to consider the representation of the petitioner dated 22.11.2018 and pass order within a time frame as fixed by this Court.
2.Heard Mr.K.Suresh, learned counsel appearing for the petitioner and Mr.M.Rajarajan, learned Government Advocate appearing for the respondent.
3.In respect of the land at S.No.331/4 to the extent of 0.41 Acre, which according to the petitioner, belongs to the petitioner, in order to get patta, the petitioner had given a detailed request/representation to the respondent on 22.11.2018. However, no action seems to have been taken by the respondent so far on the said representation. Therefore, the petitioner is before this Court. 4.The learned counsel appearing for the petitioner submits that, in respect of the said land, initially there had been some dispute between the Government and the petitioner, subsequently, on the civil Suit filed by the petitioner, there has been a declaratory decree in favour of the petitioner and on production of the same also, the respondent has not so far considered the grant of patta to the petitioner on the subject land.
5.The learned Government Advocate appearing for the respondent submits that, in view of the said factual matrix, the request of the petitioner dated 22.11.2018 would be considered by the respondent on https://hcservices.ecourts.gov.in/hcservices/
merits and in accordance with law and accordingly, suitable orders with regard to the grant of patta to the subject land of the petitioner would be passed, within a time frame that may be stipulated by this Court.
6.In view of the aforesaid stand taken by respondent and after having considered the factual matrix, this Court is inclined to pass the following order:
"that the respondent is hereby directed to consider the representation of the petitioner dated 22.11.2018 with regard to grant of patta to the petitioner's land, of course, on consideration of the civil Court decree passed in favour of the petitioner and accordingly, suitable order with regard to grant of patta could be passed on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order." 7.With this direction, this writ petition is disposed of. No costs.
