ORDER

Seeking to direct the 1st respondent to transfer the investigation of the petitioner's complaint dated 21.02.2026 on the file of the 3rd respondent to the 2nd respondent, this criminal original petition is filed.

The learned counsel for the petitioner submitted that the petitioner had already lodged a complaint before the 3rd respondent as against one Mohan Prasad and V.P.Dharmar with respect to the manner in which the petitioner was coercively evicted from his shop illegally. In this regard, the 3rd respondent police had failed to take any action and hence, sought for the indulgence of this Court by transferring the investigation from the 3rd respondent to the 2nd respondent.

3. The learned Government Advocate(Crl.Side) submitted that for the earlier complaint received from the petitioner, C.S.R.No.846 of 2025 has been issued and the same was closed based on the statement of the petitioner that the rest of the amount will be settled. The present 2/5

complaint is dated 21.02.2026 and the enquiry is pending in the said case.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

With respect to the pending enquiry which has been initiated at the instance of the petitioner's complaint dated 21.02.2026, the 3rd respondent police is directed to proceed with the enquiry and conclude the same as expeditiously as possible within a period of four(4) weeks from the date of receipt of copy of this order and further directed to apprise the progress of the investigation to the 2nd respondent every Friday. The 2nd respondent is directed to monitor the ongoing investigation conducted by the 3rd respondent. Since the petitioner's plight is that the 3rd respondent is hand in glove with the said Mohana Mohan Prasad and V.P.Dharmar, the 2nd respondent is directed to strictly monitor the 3rd respondent and direct them to conduct the enquiry in the manner known to law without any deviation. 3/5

6. With the above directions, this Criminal Original Petition stands disposed of.
