ORDER

This writ petition has been filed challenging the impugned notification No. Nil, dated 09.02.2021 and consequently direct the respondent to appoint the petitioner in the post of Assistant in the Central Co-operative Bank, Dindigul Region.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondent. Perused the materials available on record.

3.The petitioner had made an application to the post of Assistant, pursuant to the notification of the respondent, dated 12.03.2020, by which, application to the post of Assistant for 78 vacancies was called for. The written examination was conducted on 27.11.2020, following which, a list of successful candidates, who were provisionally selected for interview was published by the respondent, in which, the petitioner was placed in Sl.No.54. The provisionally selected candidates were directed to download the call letter for interview, which was scheduled to be held on 07.01.2021. The petitioner also duly downloaded the call letter and attended the interview on 07.01.2021. 2/5

Thereafter, vide impugned selection list, dated 09.02.2021, the particulars of 74 selected candidates were published by the respondent. However, the petitioner was not selected. Challenging the said selection list, dated 09.02.2021, this writ petition came to be filed.

5.The learned Government Advocate appearing for the respondents, on instructions, circulated the complete list of marks secured by the candidates, who participated in the aforesaid selection process. It would reveal that the cut-off mark for the candidates under the category of S.C(Gen) had been 53.18. However, the petitioner herein, who belongs to S.C.(Gen) category, himself had admitted in his own affidavit that he had secured only 49.35 marks in the aforesaid selection process. Further submitted that pursuant to the issuance of selection list, appointment orders were issued to the selected 74 candidates on the same day, ie., 09.02.2021 itself. Hence, pressed to dismiss the writ petition.

6.Thus, it has become clear that in view of the lower cut-off marks secured by the petitioner, his candidature was not considered by the respondent. In the aforementioned facts and circumstances of the case, this Court is of the 3/5

view that nothing survives for further consideration and hence, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
