ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 323, 506(i), 420 IPC r/w Section 4 of TNPWH Act, 2002 in Crime No.53 of 2016, seeks anticipatory bail. 2.This Court went through the contents of the F.I.R. The allegations are directly against one Gurunathan, the second petitioner herein. The said Gurunathan is said to have held out false assurances to the defacto complainant and taken a sum of Rs.4.00 lakhs from him. Since the allegations are made against the second petitioner herein, this Court is of the view that his custodial interrogation is absolutely necessary. Therefore, this petition is dismissed as far as the second petitioner is concerned. 3.

In respect of other petitioners namely, 1 and 3 to 6 herein, this Court is inclined to grant anticipatory bail to them with certain conditions. Accordingly, petitioners 1 and 3 to 6 herein are ordered to be released on bail in the event of arrest or on https://hcservices.ecourts.gov.

their appearance before the learned Judicial Magistrate No.II, Usilampatti, Madurai District and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the above said petitioners shall appear before the respondent police as and when required for interrogation. They shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously and appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
