Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in Na.Ka.No.A4/ 371/2017, dated 17.03.2020 passed by the second respondent and quash the same as illegal and consequently, direct to the respondents to fix and receive the value of land and grant assignment patta for the properties in Survey Nos. 436 and 437 to an extent of 1 Acres 85 cents, respectively situated in Kariseri Village, Sivakasi Taluk, Virudhunagar District in the ligh of the recommendation in Na.Ka.Aa1/ 3107/2021 dated 13.02.2023 of the third respondent within the period that may be stipulated by this 1/5

O R D E R
An order dated 17.03.2020 of the second respondent is challenged on the ground that the amount payable in respect of the assignment was never fixed. On account of such non-fixation, the petitioner contends that she cannot be faulted for non-payment.
2. At the previous hearing, learned Government Advocate requested time to ascertain whether the amount payable had been fixed and, if so, to produce the said documents. At today's hearing, learned Government Advocate submits that the amount payable by the petitioner was not fixed earlier. He submits that the said amount would be fixed within three (3) months from the date of receipt of a copy of this order. Upon such fixation, learned counsel for the petitioner states that the amount fixed would be paid within four (4) weeks. 2/5
3. In view of the above submissions, this Writ Petition is disposed of on the following terms:
i. The impugned order is set aside and the matter is remanded for reconsideration by the first respondent.
ii. The first respondent is directed to fix the amount payable by the petitioner in respect of the Assignment Order dated 13.02.2023 in favour of the petitioner's late husband, Sakkaraisamy, within three
(3) months from the date of receipt of a copy of this order. iii. Within one (1) month from the fixation of such amount, the petitioner is directed to pay amounts due and payable. iv. Within two (2) months from the date of such payment, Assignment Patta shall be issued to the petitioner.
v. No costs. Consequently, connected miscellaneous petition is closed.
