Respondents PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, forbearing the respondents herein, their men or subordinates or any one on their behalf from in any way interfering with the peaceful possession and enjoyment of petitioner in Survey No.10/3 measuring 1.97 acres, in Azhagia Pandipuram Village, Thovalai Taluk, Kanyakumari District and consequently direct the respondents herein to consider the petitioner for assignment patta considering his long possession and enjoyment satisfying Clause 4(5) of the Government Order in G.O (1D) No.103 dated 1.3.2007, for grant of patta to those who had in enjoyment of tharisu land for over 30 years, within a reasonable time. 1/6

O R D E R

This Writ Petition is filed seeking a direction to forbear the respondents herein, their men or subordinates or any one on their behalf from in any way interfering with the peaceful possession and enjoyment of petitioner in Survey No.10/3 measuring 1.97 acres, in Azhagia Pandipuram Village, Thovalai Taluk, Kanyakumari District and also seeking for a consequential direction, directing the respondents herein to consider the petitioner for assignment patta considering his long possession and enjoyment satisfying Clause 4(5) of the Government Order in G.O (1D) No.103 dated 1.3.2007, for grant of patta to those who had in enjoyment of tharisu land for over 30 years, within a reasonable time.

2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that the petitioner has already sent a representation on 14.01.2026, seeking to grant assignment patta to the petitioner, in respect of the subject property in terms of G.O (1D) No.103 dated 1.3.2007. Since the said representation has not been considered till date, the petitioner has filed this Writ Petition.

4. The learned Government Advocate appearing for the respondents would submit that the representation of the petitioner dated 14.01.2026 would be considered in accordance with law.

In view of the above, this Court, without going into the merits of the matter, directs the second respondent to consider and pass orders on the representation of the petitioner dated 14.01.2026, on merits and in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
