O R D E R

This petition has been filed to set aside the condition passed in Cr.M.P.No.543/2017 dated 20.02.2017.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) for the respondent.

3. The petitioner was arrested in Crime No.384/2016 on 21.11.2016 for offences under Section 397 IPC and remanded to judicial custody.

The petitioner was granted bail in Crl.M.P.No.434/2017 by the Principal District and Sessions Judge, Trichy on 10.02.2017 on condition that he should execute a bond for Rs.10,000/- with two sureties each, who must be his blood relatives.

4. It is the contention of the petitioner that he has not been able to secure two blood relatives, who would stand as sureties for Rs.10,000/- and therefore, he has not been able to enjoy the fruits of the bail order, though the bail order was granted on 10.02.2017.

5. Taking into consideration of these facts and circumstances, this Court is of the view that it would be in the interest of justice, if the aforesaid condition is modified to the effect that the petitioner shall furnish a bond for Rs.10,000/- https://hcservices.ecourts.gov.in/hcservices/

with two sureties, of whom, one surety should be his blood relative.

With the above modification, this criminal original petition is ordered. Rest of the conditions imposed by the lower Court remains unaltered.
