ORDER : The Court Made the following order :- The petitioner herein, who is arrayed as the second accused in Crime No.369 of 2013 on the file of the respondent Police, for the alleged offence punishable under Sections 302 IPC, seeks bail. 2.The learned counsel for the petitioner submits that earlier, the petitioner was granted bail and thereafter, non-bailable warrant was issued and he was arrested and remanded to judicial custody in connection with a case in Crime No.95 of 2016, since he could not appear for single hearing, on 20.04.2016. Thereafter, the petitioner filed Cr.M.P.N.127 of 2017 and the same was dismissed on 12.01.2017 and subsequently, the petitioner filed Crl.OP(MD).No.839 of 2017, which was also dismissed on 27.10.2017.

3. Heard the learned Government Advocate for the respondent police.

4. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner, by imposing stringent conditions. Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions:- (i)The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties for a like sum to the satisfaction of the *learned District and Sessions Court, Kanyakumari District at Nagercoil.

(ii). The petitioner shall report before the respondent police, daily at 10.30 a.m. until further orders.

(iii)The petitioner shall not tamper with the evidence or witnesses either during investigation or trial. (iv)The petitioner shall not abscond either during investigation or trial.
