Challenge has been made against the refusal check slip issued by the second respondent dated 10.02.2026. 2.By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
3.The learned Counsel for the petitioner would submit that the subject properties originally belonged to his father and TSLR records also reflect the name of the petitioner's father. The petitioner's father died on 14.10.2006, without settling the said properties in favour of the petitioner and other legal heirs. After his demise, the petitioner and other legal heirs were in joint possession of the subject properties. While so, now the other legal heirs intend to execute release deed in favour of the petitioner with regard to the subject properties. When the said release deed was presented before the second respondent for registration, the same was 2/6
refused, citing the reason that there are no previous documents relating to the subject properties. Hence, the present Writ Petition. 4.Per contra, learned Special Government Pleader appearing for the respondents submits that since very many entries are found in the Encumbrance Certificate and since no previous documents are found with respect to the subject properties, the second respondent has issued the impugned refusal check slip. 5.Heard the learned Counsel on either side.
6.Admittedly, in the present case, the subject properties belonged to the petitioner's father and after his demise, the petitioner and the other legal heirs were in joint possession and enjoyment of the property. Certainly, after the demise of the petitioner's father, his legal heirs are entitled to the subject properties. While so, now the other legal heirs intend to release the subject properties in favour of the petitioner, who is one of the legal heirs of the deceased father. Such being the case, I do not find any impediment for the second respondent to register the release deed presented by the petitioner and the other legal heirs. 3/6
7.Hence, the impugned order has been passed with total nonapplication of mind. Accordingly, this Writ Petition stands disposed of, by setting aside the impugned order dated 10.02.2026, passed by the second respondent. While setting aside the impugned order, this Court directs the petitioner to re-present the release deed dated 10.02.2026 to the second respondent, who shall register the same forthwith.
