Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 24.01.2018 made in regard to promoting him to the post of Sub Inspector of Police with effect from the year 2013 on completion of 25 years of service and thereby rectify the pay anomaly within a stipulated time.

ORDER

Heard Mr.G.Thalaimutharasu, learned counsel appearing for the petitioner and Mr.M.Murugan, learned Government Advocate, who accepted notice on behalf of the respondents.

2. The petitioner seeks for a direction to the respondents to consider his representation dated 24.01.2018 and to promote him to the post of Sub Inspector of Police with effect from 2013. The petitioner's case rests upon the Government Order in G.O.(Ms.) No.15, Home (Pol.V) Department, dated 07.01.2010. The learned counsel for the petitioner would submit that the petitioner has completed the required number of years of service in terms of the said Government Order and therefore, he is entitled for promotion to the post of Sub Inspector of Police.

3. Since the writ petition is disposed of at the admission stage, no positive direction can be granted to promote him to the post of Sub Inspector of Police.

4. The learned Government Advocate appearing for the respondents would submit that the second respondent may be directed to consider the representation given by the petitioner, dated 24.01.2018.

5. In the light of the above, this writ petition is disposed of by directing the petitioner to submit a fresh representation, along with a copy of this order and the copy of the representation dated 24.01.2018, in person in the Office of the second respondent and on receipt of such representation, the second respondent shall consider the same and pass orders on merits and in accordance with law, by taking note of the relevant G.O., within a period of six weeks from the date of receipt of a copy of this order. No costs.
