Respondents PRAYER:Criminal Original Petition has been filed under Section 482 of Cr.P.C., praying to direct the respondents 1 and 2 to grant police protection for the petitioner's 'life and limb' as well as for his property in Survey No.723/1B in Ayyalur Village, Vedasandur Taluk, Dindigul District, based on the representation, dated 23.05.2016.

ORDER

This petition has been filed seeking a direction to the respondents 1 and 2 to grant police protection for the petitioner's 'life and limb' as well as for his property in Survey No.723/1B in Ayyalur Village, Vedasandur Taluk, Dindigul District, based on the representation, dated 23.05.2016.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents 1 and 2.

3. The learned counsel for the petitioner would submit that the petitioner has obtained a decree dated 04.04.2008 in O.S.No.221 of 2000 before the learned District Musnif, Vedasandur, https://hcservices.ecourts.gov.in/hcservices/

which is for declaration and permanent injunction. Under such circumstances, it is alleged that the respondents 3 and 4 with the help of some henchmen attempted to prevent the petitioner from gaining access to the suit schedule property, being the subject mater of the suit in O.S.No.221 of 2000, which is already decreed in favour of the petitioner. Therefore, the petitioner, submitted a detailed representation, dated 23.05.2016, to the first respondent seeking for the relief stated above. Since the same is not considered so far, the petitioner is before this Court.

4. The learned Government Advocate (Crl. Side) would submit that CSR is pending and it is agreeable for them to consider the representations dated 23.05.2016.

5. Under such circumstances, without expressing any opinion on the merits of the matter, the respondents 1 and 2 are directed to consider the representation of the petitioner, dated 23.05.2016 and thereafter, pass orders on merits and in accordance with law.
