Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.3, apprehends arrest at the hands of the respondent police for the offence punishable under Section 397 IPC, in Crime No.317 of 2016, on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that on 02.07.2016 at 12.00 am, when the de facto complainant went near Guru Theatre, Madurai Town, three persons, at knife point, snatched a sum of Rs.4,700/- and a cell phone worth Rs.4,000/- from him. On complaint, case has been registered for the above said offences.

3.The case of the petitioner is that she is an innocent and she has not committed any offence as alleged by the prosecution. His name is not found in the FIR. Based on the confession of coaccused, he has been falsely implicated in this case. 4.The learned Government Advocate (Criminal side) submitted that the petitioner along with two other accused persons snatched a sum of Rs.4,700/- and cell phone worth Rs.4,000/- from the de facto complainant and the properties were not recovered and investigation is pending.

considering the fact that the properties were not recovered and investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly this petition is dismissed.
