Petition filed under Article 227 of the Constitution of India, praying to direct the learned District Munsif, Palani, to dispose of the O.S.No.133 of 2017 pending on the file of District Munsif Court, Palani, Dindigul District, within a time frame that may be fixed by this Court.

ORDER

This civil revision petition has been filed by the revision petitioner, seeking a direction to the learned District Munsif, Palani, to dispose of O.S.No.133 of 2017, pending on its file, within a stipulated period.

2. The revision petitioner, who is the second plaintiff, and the respondents 1 to 4 herein have filed a suit in O.S.No.133 of 2017, on the file of the learned District Munsif, Palani, for the relief of partition and permanent injunction. After filing written statement by the respondent No.5 to 8 / defendants, the suit is being adjourned without any progress. Therefore, the petitioner has come out with the present revision.

3. Heard the learned counsel appearing for the petitioner.

4. Considering the limited relief sought for by the revision petitioner, without going into the merits and demerits of the allegation raised by the revision petitioner, this civil revision petition is disposed of with the following directions: https://hcservices.ecourts.gov.in/hcservices/

"The learned District Munsif, Palani, is directed to dispose of O.S.No.133 of 2017, pending on his file, on merits and in accordance with law, as early as possible, preferably within a period of six months from the date of receipt of copy of this order. Both the parties are directed to give their fullest co-operation for trial."

No order as to costs.
