2.Sekar : Respondents Prayer: Petition is filed under Section 482 of Code of Criminal Procedure to record the present compromise memo and to quash the case registered in Crime No.599 of 2016 dated 05.012.2016 on the file of the Usilampatti Town Police Station, Usilampatti, Madurai District as far as all the petitioners / accused are concerned. O R D E R

On the complaint lodged by one Sekar, the first respondent registered a case in Crime No.599 of 2016 under Sections 147, 294 (b), 355, 452, 324, 323 and 506(ii) of the Indian Penal Code r/w Section 109 of the Indian Penal Code against Sethuraman @ Dikka Sethuraman, Ilayaraja and Periya Raja @ Raja Sivaprakash, to quash which, both parties are present before this Court on the ground that they have arrived at the compromise.

2. Today, when the matter was taken up for hearing, M/s.P.Manimozhi, Sub-Inspector of Police, Usilampatti Town Police Station, Madurai District, is present. Both parties are also present before this Court and their identifications were verified by this https://hcservices.ecourts.gov.in/hcservices/

Court, in addition to the confirmation of the identity of the parties by the learned Government Advocate (Criminal side) through Ms.P.Manimozhi, Sub-Inspector of Police, Usilampatti Town Police Station, Madurai District.

3. The petitioners and the second respondent have filed a joint compromise memo dated 02.03.2017, wherein, they have stated as follows:

"5. That now the present compromise is entered between the petitioners 1 to 3/accused 1 to 3 and the 2nd respondent / defacto complainant as they are relatives, wherein, due to wordy quarrel on the date of occurrence the present criminal case was registered.

6. That however, now, in order to prevail peace among their family and relatives, without any pressure or influence, both the parties are hereby entering into the present compromise, in order to save their family integrity, harmony and peace.

7. That the defacto complainant has no grievance and he with full consent has entered into the present compromise and the entire issue also has been compromised and settled on the welfare and harmony of the family members, as there are cordial relationship prevails between the entire family members, namely the petitioners 1 to 3 / accused 1 to 3 and the defacto complainant. Hence the entire issue is settled."

4. In view of the joint memo of compromise dated 02.03.2017, this Court is of the opinion that no useful purpose would be served in keeping the matter pending. Therefore, the entire proceedings in Crime No.599 of 2016 on the file of the first respondent, in respect of all the accused, are hereby quashed.

5. Accordingly, this Criminal Original Petition is allowed on the basis of the compromise entered into between the parties. The joint compromise memo dated 02.03.2017 shall form part of this order.
