ORDER

When the matter was taken up for hearing, the learned Government Advocate (Criminal Side), appearing for the respondent police, submitted that this is the fourth application and that three previous petitions have already been dismissed. He further submitted that a total of three previous cases are pending against the petitioner, all of which are similar in nature. 1/2 https://www.mhc.tn.gov.in/judis

2. The learned counsel appearing for the petitioner vehemently contended that the quantity involved is a commercial quantity.

3. Considering the facts of the case, this Court is of the opinion that a similar petition was already dismissed on merits, and there is no change in circumstances. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, this Criminal Original Petition stands dismissed. However, the petitioner is directed to surrender before the concerned Trial Court and file an appropriate petition. Upon such filing, the Trial Court is directed to consider the same and, while doing so, shall take into account the facts of the case.
