ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused was arrested and remanded to judicial custody on 23.07.2016 for an alleged offence punishable under Sections 417,294(b),306 r/w. 511 of IPC in Crime No.100 of 2016, seeks bail.
2. The case of the prosecution is that the petitioner and the defacto complainant were in love with each other. The petitioner promised to marry the defacto complainant. Subsequently, the petitioner arranged marriage with another girl. When the defacto complainant questioned the petitioner and demanded to marry her, the petitioner abused and threatened the defacto complainant to go and die and abetted her to commit suicide. On complaint, a case has been registered for the above said offences.
3. The learned counsel appearing for the petitioner submitted that both the petitioner and respondent loved each other, at that time, parents of the petitioner arranged marriage of the petitioner with another girl. Due to that, defacto complainant attempted to commit suicide by taking Paracetamol Tablets and the petitioner is not responsible for the act of the defacto complainant. He further submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution, https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate(Crl.side) submitted that
this Court by order dated 04.08.2016 dismissed the earlier petition filed by the petitioner in Crl.O.P(MD).No.13812 of 2016 and subsequently, the petitioner was enlarged on interim bail by this Court on 26.08.2016 in Crl.O.P(MD).No.15801 of 2016 and the matter was referred to Mediation Centre, but, the defacto complainant did not appear and the Mediation could not succeed. Hence, the matter has been referred to this Court again.
5.Considering the facts and circumstances of the case, the interim bail already granted by this Court, dated 26.08.2016 in Crl.O.P(MD).No.15801 of 2016 is made absolute. However, the petitioner shall appear before the respondent Police daily at 10.00 am until further orders.
