PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified mandamus calling for the records relating to the impugned order passed by the third respondent vide his proceedings in No.ROTRY/615/2025-CA, dated 22.02.2026 consequently grant 28 days ordinary leave without police escort to the petitioner's father namely Shanmugam, S/o. Peramaiya Nattar(convict prisoner No.22500 PID No.66640) confined at Central Prison, Tiruchirapalli forthwith considering the petitioner's representation dated 15.11.2025.

O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the third respondent in No.RO-TRY/615/2025-CA, dated 22.02.2026 consequently grant 28 days ordinary leave without police escort to the petitioner's father namely Shanmugam, S/o. Peramaiya Nattar(convict prisoner No.22500 PID No.66640) confined at Central Prison, Tiruchirapalli forthwith considering the petitioner's representation dated 15.11.2025.
2. The father of the petitioner was convicted by the III Additinoal District and Sessions Court, Pattukottai in S.C.No.71 of 2014 and which was
also confirmed by this Court. While being so the petitioner being son of the convict submitted representation seeking ordinary leave for his father on the ground that his mother is suffering from illness and as such she was advised to go for angio, however it was rejected on the ground that the convict is also facing trial in S.C.No.79 of 2019 on the file of the Sub Court, Pattukottai. While case pending for trial the convict is not eligible for ordinary leave, therefore the request made by the petitioner was rightly rejected ,thereby this Court finds no infirmity or illegality in the order passed by the third respondent.
3. Hence the writ petition(Crl.) stands dismissed. However the convict is entitled for emergency leave. In view of the same the petitioner is at liberty to submit a fresh representation seeking emergency leave on valid grounds. It is also made clear that the authorities concerned are directed to consider grant of emergency leave on production of medical certificate from the authorized Government hospital.
