Respondent PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order Na.Ka.No.01/C6 Madakulam/Ka.Ne/Inspector/26, dated 25.02.2026 on the file of the respondent and quash the same as illegal and consequently directing the respondent to grant permission and protection for the Adal Padal cultural program in the eve of Eeti Ayyanarkovil Temple on 26.02.2026 at evening at about 06.00 p.m., to 10.00 p.m.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order Na.Ka.No. 01/C6 Madakulam/Ka.Ne/Inspector/26, dated 25.02.2026 passed by the respondent and consequently to direct the respondent to grant permission and protection for the Adal Padal cultural program in the eve of Eeti Ayyanarkovil Temple on 26.02.2026 at evening at about 06.00 p.m., to 10.00 p.m.

2.The learned counsel appearing for the petitioner submitted that in every year, the petitioner and his village people are celebrating and conducting Adal Padal cultural program in the eve of Eeti Ayyanarkovil Temple in peaceful manner without any law and order problem. Therefore, the petitioner sent a representation to the respondent on 08.02.2026 seeking permission to conduct Adal Padal and the same was

rejected vide order in Na.Ka.No.01/C6 Madakulam Na.Ne/Inspector/26, dated 25.02.2026.

3. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the respondent denied permission through the impugned order stating that there is a law and order problem and the place chosen by the petitioner is a narrow place. 4.Therefore, this Court directs the respondent to fix any other place to conduct the Adal Padal cultural program. 5.In such circumstances, the impugned order is liable to be quashed. Accordingly, the impugned order passed by the respondent in Na.Ka.No.01/C6 Madakulam/Ka.Ne/Inspector/26, dated 25.02.2026 is hereby quashed. The respondent is directed to grant permission for the Adal Padal cultural program at the place chosen by the respondent on the eve of Eeti Ayyanarkovil Temple on 26.02.2026 at evening at about 06.00 p.m., to 10.00 p.m.. The petitioner shall also file an undertaking that no

obscene words, dances, communal songs, or posts will be exhibited during the programme. The respondent shall give police protection by imposing all the usual conditions.

6. With the above direction, this writ petition stands allowed. No costs.
