O R D E R

The Civil Revision Petition has been filed by the Revision Petitioner, seeking direction to expedite disposal of the suit in O.S.No. 221 of 2012, which is pending on the file of the learned District Munsif cum Judicial Magistrate-I, Usilampatti, within time frame fixed by this Court.

2. The revision petitioner is the plaintiff and the revision respondents are the defendants in O.S.No.221 of 2012. The plaintiff has filed a suit in O.S.No.221 of 2012, seeking permanent injunction and for other reliefs before the learned District Munsif cum Judicial Magistrate-I, Usilampatti. The above said suit is pending before the trial Court from the year 2012. Therefore, the revision petitioner has come forward with this Civil Revision Petition, invoking the extraordinary jurisdiction of this Court under Article 227 of Constitution of India, seeking direction to the learned District Munsif cum Judicial MagistrateI, Usilampatti to consider and pass the order within the stipulated time.

3. Heard the learned counsel for the revision petitioner and perused the available records.

No prejudice would be caused to the respondents, if this Court directs the learned District Munsif cum Judicial Magistrate-I, Usilampatti to dispose the suit in O.S.No.221 of 2012, within a period stipulated by this Court. In view of the limited scope of the prayer sought for by the petitioner, I am inclined to pass the following Order.

5. In the result, (i). this Civil Revision Petition No.998 of 2018 is disposed of.

(ii). the learned District Munsif cum Judicial MagistrateI, Usilampatti is directed to dispose the suit in O.S.No.221 of 2012 within a period of three months from the date of copy of receipt of this order by conducting the trial on day-to-day basis without giving unnecessary adjournments to either parties and the parties are directed to give their fullest cooperation for the early disposal. Consequently, connected Miscellaneous petition is closed. No costs.
