Respondents PRAYER : Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Habeas Corpus directing the respondents to produce the detenu, the petitioner's grandson minor Muhadil, aged about five years, before this Hon'ble Court and set the petitioner's grandson at liberty and hand over minor Muhadil to the petitioner.

(Order of the Court was made by V. BHARATHIDASAN, J.) Alleging that the petitioner's grandson by name Muhadil, aged about 5 years, is under the custody of the 5th respondent, who is his maternal grandfather, the petitioner has made a complaint to the respondents 1 to 3. But, so far no action has been taken by the respondents to secure the detenu. Hence, the petitioner, the grandfather of the detenu has filed the present Habeas Corpus Petition.

2. When the matter is taken up for hearing today, Mr.S.Ravi, learned Standing counsel appearing for the State, on instructions would submit that already the petitioner has approached the concerned civil Court, seeking the custody of the minor child, which is pending in G.W.O.P.No.26 of 2020.

3. Considering the fact that the petitioner has already approached the Principal District Court, Ramanathapuram, seeking the custody of the minor child, the Habeas Corpus Petition is dismissed. Sd/- Assistant Registrar (Crl side) // True Copy // / /2021 Sub Assistant Registrar(CS) akv Note:
