O R D E R

The petition has been filed under Section 439(1)(6) Cr.P.C., praying to modify the condition No.1 of the bail order dated 04.08.2016 imposed upon the petitioner by the Judicial Magistrate No.V, Trichy in Cr.M.P.No.2764 of 2016.

2.Heard the learned counsel for the petitioner and also the learned Government Advocate(Crl. Side).

3. Learned counsel for the petitioner would submit that the trial court has granted bail to the petitioner in Crl.M.P.No .2764 of 2016 imposing some conditions. The first condition is that the accused has to execute a bond for a sum of Rs.10,000/- with two sureties each for a likesum and the sureties should be Government Servants. The petitioner could not comply with the said condition and he prays for modification of the same.

5.Considering the facts and circumstances of this case, this Court considers it appropriate to modify the above said condition as follows:

The petitioner shall execute a bond in a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for a likesum to the satisfaction of the learned Judicial Magistrate No.V, Trichy.

The other conditions imposed by the court below shall stand unaltered.

7. The Criminal Original Petition is disposed of with the above modification.
