ORDER
This Petition is filed to condone the delay of 107 days in preferring the above Civil Miscellaneous Appeal.

2. Heard the learned counsel appearing for the petitioner and perused the materials placed before this Court.
3. The learned counsel appearing for respondents 1 and 2 opposed the petition by stating that the petitioner has not satisfactorily explained the delay.
4. The learned counsel appearing for the petitioner / appellant submitted that the 5th respondent is not an necessary party in the appeal and he has also filed a memo to that effect. Hence, notice to the 5th respondent is dispensed with.
5. For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is ordered and the delay is condoned.
6. Since the parties are ready to settle the matter, Registry is directed to number the Civil Miscellaneous Appeal and post it before the Lok Adalat scheduled to be held on 13.12.2025. Both the parties are directed to appear 2/4
before the Lok Adalat on that without fail.
7. If the matter is not settled before the Lok Adalat, Registry is directed to post the appeal before the Regular Court on 16.12.2025. 17.11.2025 trp 3/4
