PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for records and to quash the petition D.V.C.No.93 of 2025 on the file of the Additional Mahila Court, Dindigul and allow the Criminal Original Petition and thus render justice.

ORDER

The present petition has been filed by the respondent Nos.1 to 3 in DVC.No.93 of 2025 on the file of the Additional Mahila Court, Dindigul seeking to quash the said proceedings.

2. According to the learned Counsel appearing for the petitioners, the DVC complaint has been lodged based on false allegations. He further submits that the respondent's husband has passed away, leaving behind ample properties in the hands of the respondent. In such circumstances, the complaint against the aged in-laws would not arise.

3. Per contra, the learned Counsel appearing for the respondent/complainant submitted that, after the death of her husband, she has not been permitted to reside in the matrimonial home. She is now temporarily residing at her brother's house and she is unable to maintain her son, who is aged about 11 years. In such circumstances, the present petition has been filed.

4. He further submits that the in-laws of the respondent herein are enjoying the ancestral properties and they are earning huge sum of money. However, they are not willing to take care of the minor grandson. 2/4

5. Heard the learned Counsels appearing on either side and perused the materials available on record.

6. As could be seen from the complaint and the submissions made on either side, there is a factual dispute between the parties, and there are no legal grounds for quashing the Domestic Violence complaint.

7. In such circumstances, this Court is not inclined to quash the domestic violence complaint. However, the presence of the petitioners shall stand dispensed with, unless specifically directed by the trial court.

8. With the said observations, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petitions are closed. 18.06.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn 3/4
