ORDER : The Court made the following order :- The petitioner/sole accused, who apprehend arrest at the hands of the respondent Police for the offences punishable under Girl missing @ 366 of IPC and sections 6 of POCSO Act in Crime No.336 of 2022 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner on the false promise of marrying the victim girl had taken to Asaripallam had committed penetrative sexual assault on her several times and thereafter refused to marry her. Hence, the complaint.
3. Heard both side and perused the materials available on record including the First Information Report and the statement of the victim recorded under section 164 of Cr.P.C. https://www.mhc.tn.gov.in/judis 1/2

4. From perusal of statement of the victim recorded under section 164 of Cr.P.C, it is seen that the petitioner herein had kidnapped the minor victim girl and had committed penetrative sexual assault. Therefore the petitioner has committed very serious and heinous offence against the minor victim girl, hence custodial interrogation of the petitioner is very much require. In view of the same, this court is not inclined to grant anticipatory bail to the petitioner.
5. Hence the petition stands dismissed.
