Pleased to call for the records in S.C.No.361 of 2017 dated 22.03.2022 passed by the Learned VI Additional Sessions Judge, Madurai and to set aside the same.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARUPPASAMY PANDIIYAN G, Advocate for the petitioner and of Mr.E.ANTONY SAHAYA PRABAHAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- (Order of the Court was made by R.SURESH KUMAR, J.) Pursuant to the earlier order dated 17.03.2023, Mr.G.Karuppasamy Pandiyan, learned counsel appearing for the petitioner has produced a Transfer Certificate issued by one SRM Institute of Science and Technology. Citing the same, he would submit that the detenue, though had completed Law course, had not enrolled in the Bar Council concerned. CRL MP(MD) No.4459 of 2023 the profession, therefore, he wanted to relax the condition, is not known.
2.Mere holding of a Law degree cannot be considered to be a Lawyer, unless and until he has enrolled in the Bar Council concerned.
3.A noble profession shall not be undermined by the people, like the detenue claiming that he is a Lawyer without even getting enrolled in the Bar Council concerned. Therefore, such kind of person cannot take any shelter under the law and seek for any indulgence of this Court for getting the relief, like the relaxation of the condition imposed against him.
4.Recording the same, this Criminal Miscellaneous Petition stands dismissed.
