*********** This writ petition has been filed for a Mandamus seeking for a direction to the third and fourth respondents to sub-divide and issue a separate patta in the name of the petitioner for the lands in S.F.No.408/1A measuring an extent of 0.40.00 Hectares, S.F.No.408/1B measuring an extent of 0.14.50 Hectares, S.F.No.413/1 measuring an extent of 0.46.00 Hectares, S.F.No.413/2 measuring an extent of 0.71.00 Hectares, S.F.No.309 measuring an extent of 1.84.00 Hectares, S.F.No.414 measuring an extent of 0.58.00 Hectares, S.F.No.415/1 measuring an extent of 0.64.50 Hectares, S.F.No.415/2A measuring an extent of 0.09.00 Hectares, S.F.No.460/31 measuring an extent of 4.10 Cents, S.F.No.415/2B measuring an extent of 0.47.00 Hectares, S.F.No.417/1A measuring an extent of 0.21.00 Hectares, S.F.No.417/1B measuring an extent of 0.19.

2.The petitioner claims that she is the absolute owner of the aforementioned properties. According to her, the patta presently stands in the joint names of her family members which includes the petitioner. According to her, subsequent to an oral partition, the aforementioned properties have been allotted in her favour. In such circumstances, the petitioner seeks for separate patta in her name. The petitioner has applied for separate patta through her online application dated 10.02.2022. Since the said application has not been considered till date, the petitioner has filed this writ petition.
3.Heard Mr.K.R.Badurus Zaman, learned Counsel for the writ petitioner and Mr.B.Saravanan, learned Additional Government Pleader who accepts notice on behalf of the respondents. 4.No prejudice would be caused to the third respondent if the petitioner's online application is considered on merits and in accordance with law after affording a fair hearing to the petitioner and other necessary parties whom the third respondent deems fit to enquire.
5.Accordingly, this Court directs the third respondent to consider the petitioner's online application dated 10.02.2022 seeking for sub-division and issuance of separate patta in her name for the lands in S.F.No.408/1A measuring an extent of 0.40.00 Hectares, S.F.No.408/1B measuring an extent of 0.14.50 Hectares, S.F.No.413/1 measuring an extent of 0.46.00 Hectares, S.F.No.413/2 measuring an extent of 0.71.00 Hectares, S.F.No.309 measuring an 2/3
extent of 1.84.00 Hectares, S.F.No.414 measuring an extent of 0.58.00 Hectares, S.F.No.415/1 measuring an extent of 0.64.50 Hectares, S.F.No.415/2A measuring an extent of 0.09.00 Hectares, S.F.No.460/31 measuring an extent of 4.10 Cents, S.F.No.415/2B measuring an extent of 0.47.00 Hectares, S.F.No.417/1A measuring an extent of 0.21.00 Hectares, S.F.No.417/1B measuring an extent of 0.19.50 hectares, S.F.No.417/1C measuring an extent of 0.16.50 hectares, S.F.No.425/2 measuring an extent of 0.79.50 hectares situated at Thittangulam Village, Kovilpatti Panchayat Union, Kovilpatti Taluk, Tuticorin District (Palayamkottai Registration District) and pass final orders on merits and in accordance with law after affording a fair hearing to the petitioner and other necessary parties whom the third respondent deems fit to enquire within a period of twelve [12] weeks from the date of receipt of a copy of this order.
6.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
