ORDER : The Court Made the following order :- The petitioners, who are arrayed as A-1 and A-2 in Crime No.1 of 2017 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A) and 494 of IPC and hence, seek anticipatory bail.
2.Heard the learned counsel for the petitioners and the learned Government Advocate(Crl. Side) for the respondent/State.
3. The learned Counsel for the petitioners submitted that the defacto complainant was non other than the 1st petitioner's aunt's daughter. While the 1st petitioner was working at Maldive, he received complaint about the illegal intimacy of the defacto complainant with one Rathinam and on verification, the 1st petitioner found that the said Rathinam had illegal intimacy before her marriage. The mother of the 1st petitioner committed suicide due to the illegal intimacy of her daughter-in-law/defacto complainant and subsequently the said Rathinam has also committed suicide. Thereafter there were so many negotiations have taken place by the family members and she had refused to live with the first petitioner and did not object him to get re-marriage and thus the second marriage had taken place with the second petitioner six years back https://hcservices.ecourts.gov.in/hcservices/
and the present complaint has been lodged by the defacto complainant for motive. The petitioner is innocent.
4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Thiruvadanai and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
