O R D E R

Heard the learned Counsel appearing for the petitioner, Mr.Siddharthan, the learned Additional Government Pleader appearing for the Respondent Nos.1 to 3 and Mr.Shanmuganathan, the learned Standing Counsel for the fourth respondent and carefully perused the materials available on record.

2. The petitioner completed B.A., Literature degree in Tamil in the year 2003 in first class and she passed M.A., Literature degree in Tamil in the 2005 in first class. In the year 2006, she passed B.Ed., degree in Tamil. The petitioner also passed Teacher Eligibility Test to qualify as a Secondary Grade Teacher and also for graduate teacher. was conducted in the year 2017. The petitioner passed in the said examination, she secured 95 marks out of 150 in that examination. She received an interview letter from the Teacher Examination Board for verification of original certificates. On 24.07.2017, she had produced all educational certificates before the concerned authorities for verification and She was also issued with verification certificate. But, thereafter, she was not offered teaching job in the Government School. Since, the candidates whose certificates were verified before the year 2018, did not get teaching jobs, filed writ petition in W.P.(MD).No.26084 of 2023., etc., batch cases before this Court. The Hon'ble Division Bench of this Court by judgement dated 10.07.2024, directed to appoint the candidates who passed Teacher Examination and get their certificate verification before 20.07.2018, in the post of Secondary Grade Teacher in the vacant Government Schools.

3. The learned Counsel for the petitioner submits that the petitioner passed TET examination in the year 2017, and the certificates were verified on 24.07.2017. As per judgement of the Hon'ble Division Bench of this Court, the petitioner is entitled for the same relief. Accordingly, the petitioner submitted a representation on 06.01.2025, seeking for appointment in the vacant post in the 3/6

Government School. But, the said representation has not been considered and no orders are passed till date. Aggrieved by the in action of the authorities, the petitioner is constrained to file this writ petition.

Mr.Siddharthan, the learned Additional Government Pleader would submit that the judgement of the Hon'ble Division Bench of this Court in W.P.(MD).No.26084 of 2023 etc., batch cases is now under challenge before the Apex Court and it is pending before the Apex Court. He further submits that the representation of the petitioner would be considered in accordance with law within a time to be stipulated.

Considering the fact that the grievance of the petitioner is with regard to consideration of her representation only, in our considered view that it is appropriate and reasonable to dispose of this writ petition at the admission stage itself with the consent of both side counsel, with a direction to the third respondent to consider the representation of the petitioner dated 06.01.2025 of the petitioner in terms of the judgement passed by this Court W.P.(MD). No.26084 of 2023.

6. Accordingly, this writ petition is disposed of with the following directions :

i) The third respondent is directed to consider the representation of the petitioner dated 06.01.2025 of the petitioner, in terms of the judgement passed by this Court W.P.(MD).No.26084 of 2023 etc., batch cases. There shall be no order as to costs.
