Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the respondent to issue community certificate to petitioner's children S.Alagarsamy and S.Bhuvaneshwari evidencing the fact that they belong to Malaivedan community on the basis of the petitioner application dated 12.06.2017.

[Order of the Court was made by K.KALYANASUNDARAM, J] Heard Mr.G.Shankar Ganesh, learned counsel appearing for the petitioner, Mr.Ayiram K.Selvakumar, learned Additional Government Pleader appearing for the respondent. 2.This writ petition has been filed, seeking a direction to the respondent to issue community certificates to her children viz., S.Alagarsamy and S.Bhuvaneshwari, on the basis of the application dated 12.06.2017, submitted by her husband.

3.The petitioner would claim that she belongs to Malaivedan community, which is indicated in the list of Scheduled Tribes. But, the application for issuance of community certificates for her children was not considered. Hence, the writ petition has been filed.

application dated 12.06.2017.

5.Per contra, learned Additional Government Pleader, on instructions, would state that the respondent had already received an application for issuance of community certificate for the children of the petitioner and also obtained a report from the Village Administrative Officer and it is under process. 6.In the light of the above submissions of the learned counsels and also taking note of the prayer sought for in the writ petition, this Court, without going into the merits of the case, directs the respondent to pass appropriate orders on the application, dated 12.06.2017, purely on merits and in accordance with law, after affording an opportunity to all the necessary parties, within a period of 12 weeks from the date of receipt of a copy of this order. 7.With the above direction, the writ petition is disposed of. No costs.
