ORDER
The learned Counsel for the Petitioner submits that the Petitioner had filed this Writ Petition seeking direction against the second Respondent to grant the permission and protection to perform the festival for Theertham Yeduthal, Abishekam, Kittavettu Poojai, Mavilaku Poojai and Karakam Yeddupu from 31.03.2024 to 02.04.2024 in the eve of Arulmigu Sri Maha Mariamman Thiruvizha, Vellkankattupatti, Krishnan Rayapuram, Sivayam North Post, Kuppachipatti, Karur District.
2.The learned Government Advocate (Crl.side) submits that the Petitioner had given a representation in person to the Respondents. Before the Respondents could pass orders, he had approached this Court. He would further submit that the Petitioner wanted to conduct the festival beyond 10.00 pm., even though the second Respondent insisted that they have to complete the programme by 10.00 pm., 2/5
3.On consideration of the submission of the learned Counsel for the Petitioner and the learned Government Advocate (Crl.side), the Respondents are directed to consider the representation of the Petitioner favorably in the light of the circular of the Director General of Police, Head of State Police Force, Tamil Nadu, Chennai-4, issued in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 regarding temple festivals. If the Petitioner as Organizer of the festival insists for time beyond 10.00 pm., the Respondents 1 and 2 shall obtain an affidavit of undertaking from each of the Organizing Committee members, President, VicePresident, Secretary and Treasurer that they are responsible for any untoward incidents and they will control it through volunteers. If there is any untoward incident, the Police have the power to stop the festival. For the police protection sought by the Petitioner, he has to pay necessary charges as per the circular of the Director General of Police, Head of State Police Force, Chennai-4, issued in Rc.No.193784/PAC-2/2017, dated 19.03.2019 to the Respondent Police. 3/5
