: Respondents PRAYER : Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records relating t the impugned order dated 30.03.2019 made in C.No.3/Sa.Va.Aluvalagam/19 passed by the second respondent and the same was served by the second respondent through his subordinate to the petitioner Association on 7.4.2019 and quash the same, consequently directing the respondents to grant permission to the petitioner Association to conduct the "Sapparam Procession" on 22.04.2019 and 'Ther Procession" on 23.04.2019 at Purathakudi Village, Mannachanallur Taluk, Tiruchirappalli District and consequently to consider the representation dated 19.03.2019 and 26.03.2019 made by the petitioner's association. O R D E R

The petitioner seeks permission for conducting some religious procession on 22.04.2010 and 23.04.2019. The same was rejected by the second respondent Vide his proceeding dated 30.03.2019. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl.sid) appearing for the respondents.

3. The learned counsel for the petitioner submitted that since the matter is listed only today, the petitioner would be holding the said celebrations as and when the orders are passed by the second respondent.

4. The learned Government Advocate (Crl. Side) appearing for the respondents brought to the notice of this Court that there is another group of Dalit Christians who live predominantly along the route through which the procession/celebration is contemplated and it also want to join the celebration, but there is some reservation expressed by the petitioner. Since this may lead to law and order problem between two groups, the second respondent has justly declined permission. The learned Government Advocate (Crl.side)) has conceded that 'Ther' intended for 'Therottam' belongs to the petitioner's association.

5. In response the learned counsel for the petitioner submitted that the petitioners are only organizing 'Therottam' and participation in which is not restricted to members of the association. Even a non member of the Association can participate without any right to organize 'Therottam'. The said submission of the learned counsel for the petitioner is recorded.

6. The petitioner is now directed to file a fresh representation to the second respondent police indicating therein its willingness to accept the limited participation of Dalit Christians who love along the route indicated, whereupon the second respondent is directed to consider the same and pass such appropriate orders granting permission.

7. With the above direction, this Writ Petition is disposed of. No costs.
