O R D E R

The petitioner has been filed this petition, seeking a direction to the respondent to register a case, based on the complaint given by him, on 07.09.2015.

2.The petitioner has given a complaint before the respondent police alleging that one Anbumani, an official working in the Koodankulam Nuclear Power Project, Tirunelveli District, has illegally removed copper sleeve materials worth about Rs.2 Crores, without proper authority and also misappropriated the fund. Since no action has been taken based on his complaint, he has filed the present petition.

3.Today, when the matter is taken up for hearing, the learned Special Public Prosecutor for CBI Cases filed a counter stating that based on the complaint given by the petitioner, the respondent/ Central Bureau of Investigation verified the allegation and found that no copper cable with sleeves was removed https://hcservices.ecourts.gov.in/hcservices/

during the alleged period and on verification, the Vigilance Department Officials could not confirm the allegation of removal of copper cables worth of Rs.2 crores from Nuclear Power Project, Koodankulam.

4.I have heard Mr.S.Balamurugan, learned counsel appearing for the petitioner and Mr.S.Jayakumar, learned Special Public Prosecutor for CBI Cases appearing for the respondent and perused the records carefully.

5.Since, already, the petitioner's complaint was enquired and on verification, it was found that there was no truth in the allegation, the prayer sought for by the petitioner cannot be granted.
